RENTAL TERMS

  1. Inspection: Customer has inspected and tested all of the equipment being leased hereunder. Customer agrees that such equipment is in good working condition, acceptable to Customer, and free from damage or defect. Customer assumes all risks inherent in inspection and testing and shall be liable for all damage caused to equipment, property, or persons during inspection and testing.

INSURANCE

Physical loss or damage does not cover:

1. Loss or damage caused by wear and tear, gradual deterioration, inherent

defect, rust or oxidation, condensation, change in temperature, moth or

vermin, warping or shrinkage;

2. Electrical or mechanical fault or breakdown, unless caused by external

accidental damage;

3. Scratching of lenses;

4. Loss or damage caused by or resulting from repairing, restoring,

maintenance, or any similar process;

5. Faulty workmanship or design, or the use of faulty materials;

6. Loss of earnings, loss of market, loss of use, or any remote or consequential

loss;

7. Loss, damage or liability directly or indirectly caused by riots, strikes or civil

commotion;

8. Loss, damage, liability or contamination caused by or arising directly or

indirectly from an act of terrorism (or threat of an act of terrorism).

9. Loss, damage or liability arising directly or indirectly from nuclear reaction,

nuclear radiation or radioactive contamination;

10. Loss, damage or liability directly or indirectly caused by war, invasion, act

of foreign enemies, hostilities (whether war be declared or not), civil war,

rebellion, revolution, insurrection, military or usurped power;

11. loss or damage caused by or resulting from confiscation, nationalisation,

requisition or destruction of or damage to property by or under the order of

any government or public or local authority.

12. Any amount in excess of € 50,000 for a claim resulting from theft from an

unattended motor vehicle, unless at the time of the theft:

a. The ignition key was removed from the vehicle, and

b. all doors, windows and other openings were securely closed and

locked, and

c. All items were stored out of sight, and

d. if the vehicle was parked overnight, it was parked in a fully

enclosed, securely locked building or in a permanently attended

vehicle security park or compound secured by locked gates.

13. Loss or damage occurring when the equipment is used underwater or in

wet or humid environments.

14. Loss or damage to equipment whilst it is on-board or attached to a remote

controlled vehicle, aircraft or watercraft. This exclusion does not apply to

purpose-built camera dollies or cranes.

15. Loss or damage caused by or resulting from unsuitable, insufficient or

inadequate packing or labelling.

16. any loss, damage, liability or expense directly or indirectly caused by,

contributed to by or arising from:

a) the failure, error or malfunction of any computer, computer system,

computer software programme, code, or process or any other electronic

system, or

b) the use or operation, as a means for inflicting harm, of any computer,

computer system, computer software programme, malicious code,

computer virus or process or any other electronic system. (LMA5402)

17. any loss, damage or liability directly or indirectly caused by or resulting

from communicable disease or the threat or fear of communicable disease

(whether actual or perceived).
